Head-On Collision brought on by Surfing the Internet While Driving

Surfing the internet while driving is extremely dangerous, proven by a recent accident. A driver that drifted into oncoming traffic and collided head-on with another vehicle has died of his injuries. He died on a Tuesday morning of injuries he suffered when his vehicle collided the previous Saturday with a Jeep. A passenger in Driver 1’s vehicle, was also killed in the collision,

Police say they believe that about 1:45 p.m. Saturday, the driver was driving north on Seventh Street near Northern Avenue and got distracted by trying to look up an address on a laptop computer. Yes, he had a laptop in the front seat and it was on.

His vehicle crossed over into oncoming traffic and struck the second driver’s vehicle, it was reported. The airbags deployed for all three people involved in the crash.  It was unknown if the first driver or his passenger were wearing seatbelts.

This is just so sad in so many ways. Surfing the internet while driving – that takes it to another level of danger, and unfortunately with fatal consequences. Please resist the urge to text, surf the internet or take your eyes off of the road, as death or serious injury can result.

Does the driver of the second vehicle have a claim against the estate of the distracted driver and his insurance company for causing this horrific accident?  Yes.

Does the passenger of the the first vehical have a claim against the estate of the distracted driver and his insurance company for causing this horrific accident?  Yes.

Is the passenger of the the first vehical at fault?  Most likely the answer is no. Connecticut law generally places full responsibility on the operator of a motor vehicle, absent some “active” negligence by a passenger (i.e. grabbing the wheel, or otherwise disturbing the driver’s safe operation etc.).

There are no winners here. In this preventable accident, everyone loses.
